A Will is a written legal document that details what is to happen
after a person's death. Typically a Will names a guardian to care
for any minor children, a personal representative who will be
responsible for managing your affairs and the beneficiaries who
will receive the proceeds of your estate.

Your estate generally consists of the money and property you
own in at the time of your death. Determining the property and
funds that may become part of your estate should include
reviewing bank accounts, financial documents, insurance policies,
retirement funds and jointly owned property.

Since the property you own often changes over time, or the
persons you wish to have as personal representative, trustee or
beneficiaries may have changed, or you may simply change your

Powers of Attorney
A Power of Attorney is a legal instrument that is used to delegate
legal authority to another. The person who signs(executes)a
Power of Attorney is called the Principal. The power of Attorney
gives legal authority to another person(called an Agent or
Attorney-in-Fact) to make property, financial and other legal
decisions for the Principal.

A Principal can give an Agent broad legal authority, or very limited
authority. The Power of Attorney is frequently used to help in the
event of a Principal's illness or disability, or in legal transactions
where the principal cannot be present to sign necessary legal
documents.
A Guardian takes responsibility of the care and management of
an incompetent adult or minor child, the ward.  Guardianship
transfers the rights and powers from a Ward to a Guardian.

The Guardian only has the powers specified in the letters of
Guardianship.  In those areas designated by the court, the
Guardian of an incapacitated person has the same powers, rights
and duties to  the Ward as a parent has to a child.  

Guardianship proceedings begin with the filing of a petition in the
county court in which the person alleged to be incapacitated lives.
A petition may be filed by the person who allegedly is
incapacitated or by anyone interested in the person’s welfare. For

health care directive or a durable power of attorney for health
care will assist your family in knowing what your wishes are during
